INSTALLATION SERVICE AGREEMENT
CUSTOMER WAIVER & LEGAL DISCLOSURES
Effective Date: July 1, 2026
IMPORTANT NOTICE PLEASE READ THIS AGREEMENT CAREFULLY.
By requesting a quote, scheduling an appointment, submitting payment, selecting “I Agree” during checkout, signing a work order, accepting services, or allowing HOME STARLINK LLC or its employees, representatives, independent contractors, or subcontractors to perform work on your property, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. If you do not agree to these Terms and Conditions, do not schedule service or permit any work to be performed.
1. DEFINITIONS
Throughout this Agreement:
“HOME STARLINK LLC,” “HOME STARLINK,” “Company,” “we,” “our,” and “us” refer to HOME STARLINK LLC and its owners, officers, members, managers, employees, representatives, affiliates, independent contractors, subcontractors, successors, and assigns. “Customer,” “Client,” “you,” and “your” refer to the individual or entity requesting, purchasing, scheduling, or receiving services from HOME STARLINK LLC.
“Services” include, but are not limited to:
* Starlink equipment installation
* Equipment relocation
* Equipment mounting
* Temporary equipment setup
* Site inspections
* Signal testing
* Cable routing
* Cable management
* Networking assistance
* Wi-Fi optimization
* Equipment troubleshooting
* Consultation services
* Residential installations
* Commercial installations
* Agricultural installations
* Marine, RV, and mobile installations
* Any related labor, recommendations, or support services offered by HOME STARLINK LLC.
2. INDEPENDENT COMPANY DISCLOSURE
HOME STARLINK LLC is an independent installation, consulting, and technical support company. HOME STARLINK LLC is not affiliated with, endorsed by, sponsored by, authorized by, or acting on behalf of Starlink, Space Exploration Technologies Corp. (SpaceX), or any of their subsidiaries, affiliates, successors, or related entities. HOME STARLINK LLC does not represent Starlink or SpaceX in any capacity and has no authority to bind either company to any agreement, warranty, representation, pricing, promotion, or obligation. Nothing contained within this Agreement or on the HOME STARLINK LLC website shall be interpreted as creating any partnership, agency relationship, joint venture, franchise, employment relationship, or official association with Starlink or SpaceX.
3. TRADEMARK NOTICE
The names Starlink, SpaceX, and all related trademarks, logos, service marks, trade names, product names, and intellectual property remain the exclusive property of their respective owners. References to “Starlink” throughout this Agreement and on the HOME STARLINK LLC website are used solely for descriptive and nominative purposes to identify the products with which HOME STARLINK LLC provides independent installation and consulting services. Such references do not imply sponsorship, endorsement, authorization, certification, partnership, approval, or affiliation. Customers seeking official Starlink customer service, warranty assistance, billing support, account management, equipment purchases, or technical support should contact Starlink directly through its official website.
4. SCOPE OF SERVICES
HOME STARLINK LLC offers independent installation and consulting services relating to Starlink equipment.
Services may include, but are not limited to:
* Site evaluations
* Equipment placement recommendations
* Temporary equipment setup
* Roof, wall, pole, fascia, soffit, eave, or ground mounting
* Cable routing
* Interior cable management
* Network optimization
* Router configuration assistance
* Equipment relocation
* Existing installation improvements
* Removal and reinstallation services
* General consultation
HOME STARLINK LLC reserves the right to determine the appropriate installation methods, routing paths, equipment recommendations, scheduling procedures, and personnel necessary to safely complete each project. Nothing in this Agreement obligates HOME STARLINK LLC to perform work determined to be unsafe, impractical, unlawful, or beyond the Company’s capabilities.
5. COMPANY RESERVATION OF RIGHTS
HOME STARLINK LLC reserves the right, in its sole discretion and to the fullest extent permitted by applicable law, to:
* modify, amend, revise, or update these Terms and Conditions;
* change pricing, labor rates, travel charges, deposits, or service fees;
* add, remove, suspend, or discontinue services;
* revise installation procedures;
* change scheduling policies;
* modify warranty terms;
* revise refund policies;
* update website content;
* discontinue promotions or referral information;
* refuse or cancel service requests;
* decline projects determined to present unreasonable safety, legal, structural, or operational risks.
Updated Terms become effective upon publication on the HOME STARLINK LLC website and apply to future estimates, appointments, and transactions. Changes will not retroactively alter completed services or fully executed agreements unless required by applicable law or agreed to in writing by both parties.
6. CUSTOMER ACKNOWLEDGEMENT
By requesting service or submitting payment, Customer acknowledges that they:
* have read this Agreement in its entirety;
* understand its contents;
* have had an opportunity to ask questions before purchasing services;
* voluntarily agree to these Terms and Conditions;
* understand that electronic acceptance constitutes a legally binding agreement to the fullest extent permitted by applicable law;
* understand that HOME STARLINK LLC may rely upon this electronic acceptance in scheduling and performing services.
This Agreement is intended to be legally binding upon the Customer, their heirs, successors, assigns, representatives, insurers, and any person acting on their behalf.
7. STARLINK REFERRAL PROGRAM DISCLOSURE (“FREE MONTH OF SERVICE”)
From time to time, HOME STARLINK LLC may display a Starlink Referral QR Code, referral link, or promotional information regarding the official Starlink Referral Program. The “One Free Month of Service” promotion is offered, administered, fulfilled, and controlled solely by Starlink and is not a promotion created or administered by HOME STARLINK LLC. By scanning a referral QR code or selecting a referral link provided by HOME STARLINK LLC, the Customer will be redirected to Starlink’s official website to purchase Starlink equipment and internet service directly from Starlink.
HOME STARLINK LLC:
* Does not sell Starlink Internet service.
* Does not activate Starlink accounts.
* Does not collect subscription payments.
* Does not process Starlink orders.
* Does not administer referral rewards.
* Does not determine eligibility.
* Does not guarantee referral credits.
* Does not guarantee a free month of service.
Eligibility, availability, account qualifications, activation requirements, billing credits, redemption procedures, geographic restrictions, and promotional availability are determined solely by Starlink and remain subject to Starlink’s Terms and Conditions. Scheduling installation through HOME STARLINK LLC is not required to receive any referral reward. Likewise, purchasing installation services from HOME STARLINK LLC does not guarantee qualification for Starlink’s referral program. Customers are solely responsible for reviewing Starlink’s current Referral Program Terms before purchasing service. HOME STARLINK LLC assumes no responsibility for discontinued promotions, modified referral programs, denied credits, or changes made by Starlink.
8. PRICING, PAYMENT & DEPOSITS
Unless otherwise stated in writing, all service fees are due before scheduling or performing services. Accepted payment methods are determined by HOME STARLINK LLC and may change without notice. Failure to submit payment may delay scheduling or result in cancellation of the requested appointment. HOME STARLINK LLC reserves the right to require partial or full payment before dispatching technicians or subcontractors. Returned payments, chargebacks, payment disputes, or fraudulent transactions may result in immediate cancellation of services and may be referred for collection or legal action. Customer agrees to reimburse HOME STARLINK LLC for any collection costs, processing fees, bank fees, attorney’s fees, or court costs incurred in recovering unpaid balances where permitted by law.
9. STANDARD INSTALLATION PRICING
The standard residential installation fee is: $150.00 Unless otherwise stated in writing, the standard installation includes only basic labor necessary for a standard installation.
The standard installation fee does not include:
* Applicable sales tax
* Permit fees
* HOA fees
* Specialty mounting hardware
* Roof mounts
* Pole mounts
* Wall mounts
* Tripods
* Non-standard brackets
* Roof sealing materials
* Extended cable runs
* Additional networking equipment
* Electrical work
* Drywall repair
* Painting
* Landscaping
* Tree trimming
* Custom fabrication
* Crane or lift rentals
* Special safety equipment
* Travel outside normal service areas
* Any additional labor required due to site conditions
Additional charges will be quoted whenever reasonably possible before work begins.
10. TEMPORARY TESTING SETUP
Prior to permanent installation, Customer may request a Temporary Testing Setup.
The purpose of the Temporary Testing Setup is to allow activation and testing of Starlink service before permanent mounting or drilling occurs.
The Temporary Testing Setup may include:
• Window pass-through connector
• Temporary cable extension
• Temporary routing accessories
• Temporary equipment positioning
The Temporary Testing Setup requires a $25 Temporary Equipment Deposit. This deposit is fully refundable once all temporary equipment is returned to HOME STARLINK LLC in good, clean, working condition, reasonable wear excepted. Equipment returned damaged, altered, incomplete, excessively worn, or non-functional may result in partial or complete forfeiture of the deposit based upon replacement cost. HOME STARLINK LLC reserves the right to inspect all returned equipment before approving any refund.
11. CUSTOMER-PURCHASED MOUNTING EQUIPMENT
During the site inspection, a HOME STARLINK LLC representative will evaluate the property and recommend the mounting equipment best suited for the Customer’s home.
Recommendations are based upon:
* Roof construction
* Roof pitch
* Exterior materials
* Wind exposure
* Structural considerations
* Local installation requirements
* Home appearance
* Color matching
* Architectural style
* Safety considerations
HOME STARLINK LLC recommends mounting hardware solely for compatibility and installation purposes. Permanent mounting brackets, roof mounts, poles, adapters, flashing kits, lag bolts, mounting plates, specialty fasteners, and related accessories are not included within the standard installation fee unless specifically identified in writing. The Customer is solely responsible for purchasing the recommended mounting equipment prior to the installation appointment. HOME STARLINK LLC may recommend retailers or manufacturers but does not require Customers to purchase equipment from any specific source.
12. ADDITIONAL LABOR & UNFORESEEN CONDITIONS
Every property is unique. If HOME STARLINK LLC discovers conditions requiring additional labor, materials, equipment, or travel after arriving at the installation site, Customer will be notified before additional work is performed whenever reasonably practicable.
Examples include:
* Longer cable routes
* Unexpected roof conditions
* Concrete drilling
* Brick or stone installation
* Crawlspace work
* Attic work
* Difficult roof access
* Safety equipment requirements
* Structural limitations
* Existing wiring complications
* Customer-requested changes
* Additional network equipment
No additional billable work will be performed without Customer approval except where necessary to safely secure equipment already installed or where immediate action is reasonably necessary to prevent property damage or personal injury.
13. CANCELLATIONS & RESCHEDULING
Customers may cancel or reschedule appointments by contacting HOME STARLINK LLC before the scheduled appointment time. Repeated cancellations, missed appointments, refusal of access to the property, unsafe conditions, or failure to obtain required approvals may result in cancellation fees or forfeiture of deposits where permitted by law. HOME STARLINK LLC reserves the right to reschedule appointments due to:
* Weather
* Technician illness
* Equipment availability
* Safety concerns
* Traffic
* Supply shortages
* Manufacturer delays
* Emergencies
* Events beyond reasonable control
HOME STARLINK LLC shall not be liable for delays resulting from such events.
14. REFUND POLICY
Unless otherwise required by law or agreed to in writing:
* Inspection fees are non-refundable.
* Consultation fees are non-refundable.
* Labor charges are non-refundable once services begin.
* Completed installation services are non-refundable.
* Travel charges are non-refundable.
* Scheduling fees are non-refundable.
Temporary Equipment Deposits remain refundable in accordance with Section 10.
Refund requests, if approved, shall be issued using the original payment method whenever reasonably practicable.
15. CUSTOMER AUTHORIZATION
By scheduling service, submitting payment, electronically accepting these Terms, or permitting HOME STARLINK LLC to begin work, Customer expressly authorizes HOME STARLINK LLC to perform the requested services at the designated property.
Customer certifies that they are either:
* The legal owner of the property;
* A tenant or occupant with permission from the property owner; or
* Otherwise legally authorized to approve the requested installation.
If Customer lacks authority to authorize installation, Customer assumes all responsibility for obtaining the required consent before work begins.
HOME STARLINK LLC is not responsible for disputes arising between the Customer and any property owner, landlord, homeowners’ association (HOA), property management company, or other third party regarding permission to perform the requested work.
16. PROPERTY OWNER & HOA APPROVAL
The Customer is solely responsible for obtaining all required approvals, permits, permissions, and authorizations before installation, including but not limited to:
* Property owner approval
* Landlord approval
* HOA approval
* Condominium association approval
* Historic district approval
* Municipal permits
* Building permits
* Utility easements
* Any other governmental or private approvals
HOME STARLINK LLC does not verify whether such approvals have been obtained and shall not be liable for fines, penalties, removal costs, or disputes arising from a failure to secure them.
17. SUBCONTRACTOR AUTHORIZATION
Customer understands and agrees that HOME STARLINK LLC may perform services through its employees, independent contractors, subcontractors, technicians, consultants, or other authorized service providers. HOME STARLINK LLC may assign, delegate, or subcontract any portion of the requested services without additional notice to the Customer. All subcontractors performing services on behalf of HOME STARLINK LLC are considered authorized representatives for purposes of completing the installation. While HOME STARLINK LLC endeavors to work with qualified professionals, subcontractors remain independent businesses responsible for complying with applicable licensing, insurance, and legal requirements.
18. RIGHT OF ENTRY
Customer grants HOME STARLINK LLC, its employees, subcontractors, and authorized representatives permission to enter the property as reasonably necessary to perform the requested services.
This authorization includes reasonable access to:
* Roofs
* Exterior walls
* Attics
* Crawlspaces
* Utility areas
* Garages
* Interior living spaces
* Equipment locations
* Existing network equipment
* Other areas reasonably necessary to complete the installation.
Customer agrees to provide safe and unobstructed access to all required work areas.
If access cannot be safely obtained, HOME STARLINK LLC may postpone or cancel the installation without liability.
19. INSTALLATION AUTHORIZATION
Customer expressly authorizes HOME STARLINK LLC to perform installation activities that may include:
* Mounting Starlink equipment
* Routing cables
* Installing cable clips and fasteners
* Drilling holes through approved building materials
* Installing weatherproof entry points
* Applying sealants where appropriate
* Mounting brackets
* Adjusting equipment placement
* Securing cables
* Performing signal testing
* Connecting customer-owned networking equipment as requested
HOME STARLINK LLC will use commercially reasonable care in selecting installation methods appropriate for the property.
20. ROOF ACCESS & DRILLING AUTHORIZATION
Customer understands that certain installations may require:
* Roof access
* Ladder use
* Drilling into exterior walls
* Drilling through siding
* Soffit access
* Fascia mounting
* Eave mounting
* Roof penetrations
* Concrete drilling
* Masonry drilling
* Wood framing attachment
* Pole installations
* Ground-mounted systems
By accepting this Agreement, Customer authorizes HOME STARLINK LLC to perform such work when reasonably necessary to complete the requested installation.
Customer acknowledges that certain installation methods necessarily involve permanent modifications to the structure. HOME STARLINK LLC will use commercially reasonable installation practices designed to minimize cosmetic impact while maintaining installation integrity and safety.
21. HIDDEN CONDITIONS DISCLAIMER
Customer understands that walls, ceilings, roofs, attics, crawlspaces, and other concealed areas may contain hidden conditions not visible before work begins.
HOME STARLINK LLC shall not be responsible for concealed or unknown conditions including, but not limited to:
* Electrical wiring
* Plumbing
* Gas lines
* Sewer lines
* HVAC components
* Fire suppression systems
* Alarm wiring
* Fiber optic cables
* Telephone wiring
* Low-voltage wiring
* Structural defects
* Water damage
* Mold
* Rot
* Pest damage
* Prior construction defects
HOME STARLINK LLC will exercise reasonable care during installation but cannot guarantee the absence of concealed hazards.
22. CUSTOMER RESPONSIBILITIES
Customer agrees to:
* Provide accurate installation information.
* Ensure the work area is safe and accessible.
* Secure pets before technicians arrive.
* Remove valuable or fragile items from the work area.
* Provide electrical power if required.
* Ensure internet equipment has been received prior to the appointment unless otherwise agreed.
* Purchase recommended mounting hardware before installation, unless supplied under a separate written agreement.
* Inspect the completed installation before the technician departs whenever reasonably possible.
Failure to satisfy these responsibilities may delay or prevent completion of the installation.
23. SITE SAFETY
HOME STARLINK LLC reserves the right to refuse, postpone, or discontinue work whenever installation conditions are determined to be unsafe.
Examples include:
* Severe weather
* Ice or snow accumulation
* High winds
* Lightning
* Dangerous roof conditions
* Aggressive animals
* Unsafe ladders or structures
* Hazardous materials
* Criminal activity
* Unsafe electrical conditions
* Any situation posing an unreasonable risk to persons or property
Safety determinations shall be made solely at the discretion of HOME STARLINK LLC or the on-site technician.
24. PHOTOGRAPHIC DOCUMENTATION
Customer authorizes HOME STARLINK LLC to take photographs or videos of the installation area before, during, and after completion of the work.
Such documentation may be used for:
* Installation records
* Quality control
* Warranty administration
* Insurance documentation
* Customer support
* Training
* Legal documentation
HOME STARLINK LLC will not intentionally disclose Customer personal information through such photographs except as reasonably necessary to perform services, respond to claims, comply with legal obligations, or protect the Company’s legal interests.
25. CUSTOMER INSPECTION & ACCEPTANCE OF WORK
Upon completion of the installation, the Customer shall be provided an opportunity to inspect the work performed.
Customer agrees to promptly notify HOME STARLINK LLC of any concerns before the technician departs whenever reasonably practicable.
If Customer is unavailable to inspect the completed work, the installation shall be deemed accepted upon completion unless Customer reports a workmanship concern within a reasonable period after the installation. Minor cosmetic variations inherent in residential installation services, including cable routing, fastener placement, sealant application, and mounting location, shall not constitute defective workmanship when consistent with commercially reasonable installation practices.
26. PROPERTY DAMAGE REPORTING
If Customer believes property damage occurred during the performance of services, Customer agrees to notify HOME STARLINK LLC as soon as reasonably possible after discovery and, whenever practical, before making repairs or altering the affected area.
The notice should include:
* Customer name
* Service address
* Date of installation
* Description of the alleged damage
* Photographs, if available
* Any other information reasonably requested by HOME STARLINK LLC
HOME STARLINK LLC reserves the right to inspect the claimed damage or arrange for inspection before repairs are completed whenever reasonably practicable.
Failure to provide timely notice may limit HOME STARLINK LLC’s ability to investigate the claim.
27. SUBCONTRACTOR CLAIMS ASSISTANCE
Where installation services were performed by an independent contractor or subcontractor, HOME STARLINK LLC will make commercially reasonable efforts to assist the Customer by facilitating communication with the responsible service provider and cooperating in the investigation of the claim. HOME STARLINK LLC is not the insurer or guarantor of any subcontractor’s work and does not guarantee that any claim will be approved, paid, or resolved in a particular manner.
Nothing in this section limits any responsibility that cannot legally be limited or disclaimed under applicable law.
28. WORKMANSHIP WARRANTY
Unless otherwise stated in writing, HOME STARLINK LLC warrants only the workmanship of its installation services.
This warranty applies solely to labor performed by or on behalf of HOME STARLINK LLC and does not extend to:
* Starlink equipment
* Routers
* Mesh systems
* Cables supplied by Starlink
* Power supplies
* Software
* Firmware
* Manufacturer defects
* Internet service performance
* Satellite connectivity
* Weather-related interruptions
* Damage caused by third parties
* Customer modifications
* Natural disasters
* Misuse or abuse
Warranty service may be denied where the installation has been altered, relocated, repaired, or modified by anyone other than HOME STARLINK LLC or its authorized representatives.
29. THIRD-PARTY PRODUCTS
HOME STARLINK LLC does not manufacture, distribute, or warrant Starlink equipment or any third-party products. All manufacturer warranties remain solely with the applicable manufacturer.
HOME STARLINK LLC makes no representation regarding:
* Equipment availability
* Product recalls
* Product defects
* Software updates
* Firmware compatibility
* Internet speeds
* Network availability
* Satellite coverage
* Service interruptions
* Manufacturer support
Questions regarding Starlink products or subscriptions should be directed to Starlink.
30. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, HOME STARLINK LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or economic damages arising out of or relating to the services provided.
Examples include, but are not limited to:
* Lost profits
* Lost business opportunities
* Lost income
* Business interruption
* Loss of data
* Loss of use
* Internet outages
* Signal interruptions
* Delayed installations
* Missed appointments
* Weather-related delays
* Shipping delays
* Manufacturer delays
* Utility outages
* Third-party acts
* Acts of God
* Government actions
* Supply chain disruptions
To the extent permitted by law, HOME STARLINK LLC’s total liability for any claim arising from a particular installation or service shall not exceed the amount actually paid by the Customer for the specific service giving rise to the claim.
Nothing in this Agreement limits liability where such limitation is prohibited by applicable law.
31. ASSUMPTION OF RISK
Customer understands that installation of satellite internet equipment may involve inherent risks, including work performed at elevated heights, roof access, ladder use, structural attachment, drilling, cable routing, weather exposure, and interaction with existing building components. By requesting installation, Customer acknowledges these inherent risks and voluntarily authorizes HOME STARLINK LLC to perform the requested work using commercially reasonable methods. Customer further acknowledges that no installation can be guaranteed to be entirely free from cosmetic impact or unforeseen complications due to concealed building conditions.
32. CUSTOMER INDEMNIFICATION
To the fullest extent permitted by applicable law, Customer agrees to indemnify and hold harmless HOME STARLINK LLC, its owners, officers, employees, representatives, and authorized subcontractors from claims, damages, liabilities, costs, or expenses arising out of:
* Customer’s breach of this Agreement;
* Customer’s failure to obtain required permissions or approvals;
* Inaccurate information provided by Customer;
* Unsafe property conditions not created by HOME STARLINK LLC;
* Unauthorized alterations made after installation; or
* Claims brought by third parties arising from the Customer’s authorization of the work.
This provision does not require Customer to indemnify HOME STARLINK LLC for liability that cannot legally be shifted under applicable law.
33. FORCE MAJEURE
HOME STARLINK LLC shall not be responsible for delays or failures to perform resulting from events beyond its reasonable control, including but not limited to:
* Severe weather
* Natural disasters
* Fire
* Flood
* Lightning
* Utility failures
* Internet outages
* Labor shortages
* Transportation disruptions
* Government actions
* Public emergencies
* Pandemics
* Supply shortages
* Manufacturer delays
* Acts of God
In such circumstances, HOME STARLINK LLC may reschedule services without liability.
34. INSURANCE
HOME STARLINK LLC may maintain insurance coverage appropriate to its business operations as determined by the Company. Nothing contained in this Agreement shall be interpreted as expanding or reducing any rights, obligations, or limitations under any applicable insurance policy.
35. NO GUARANTEE OF INTERNET PERFORMANCE
Customer understands that HOME STARLINK LLC cannot guarantee:
* Internet speed
* Latency
* Network availability
* Satellite visibility
* Service uptime
* Signal quality
* Coverage
* Equipment availability
* Starlink account approval
* Starlink service activation
* Future software compatibility
Performance of the Starlink system depends upon numerous factors outside the control of HOME STARLINK LLC, including Starlink’s network, equipment, environmental conditions, weather, obstructions, and future software or hardware changes. HOME STARLINK LLC provides installation services only and does not guarantee the performance of third-party internet services.
36. PRIVACY & ELECTRONIC COMMUNICATIONS
Customer consents to receive communications from HOME STARLINK LLC by telephone, email, SMS text message, or other electronic means regarding estimates, appointments, scheduling, invoices, receipts, service updates, warranty matters, customer support, and other business-related communications. Customer is responsible for providing accurate contact information and promptly notifying HOME STARLINK LLC of any changes.
37. ELECTRONIC SIGNATURES
Customer agrees that clicking “I Agree,” checking an acceptance box, submitting payment, replying affirmatively by electronic communication, signing electronically, or otherwise authorizing HOME STARLINK LLC to begin work constitutes the Customer’s electronic signature. Customer agrees that such electronic acceptance has the same legal force and effect as an original handwritten signature to the fullest extent permitted by applicable law. Electronic records maintained by HOME STARLINK LLC shall be admissible as evidence of Customer acceptance.
38. ENTIRE AGREEMENT
This Agreement, together with any written estimate, invoice, work order, or other written document expressly incorporated by reference, constitutes the complete and exclusive agreement between HOME STARLINK LLC and the Customer concerning the services provided. This Agreement supersedes all prior oral or written discussions, proposals, advertisements, representations, understandings, negotiations, or agreements relating to the services. No verbal statement by any employee, technician, representative, subcontractor, or other person shall modify this Agreement unless confirmed in writing by an authorized representative of HOME STARLINK LLC.
39. CHANGES TO TERMS, SERVICES & PRICING
HOME STARLINK LLC reserves the right, in its sole discretion and to the fullest extent permitted by applicable law, to:
* Modify these Terms and Conditions;
* Revise pricing, fees, deposits, and labor rates;
* Add, modify, suspend, or discontinue services;
* Change installation procedures;
* Update warranty provisions;
* Revise refund and cancellation policies;
* Modify scheduling policies;
* Update website content;
* Change promotional offers;
* Add or remove service areas; and
* Make other operational or administrative changes as deemed reasonably necessary for the operation of the business.
Updated Terms become effective upon publication on the HOME STARLINK LLC website and shall apply to future services, appointments, estimates, purchases, and transactions occurring after the effective date of the revision.
Unless otherwise required by law or agreed to in writing by both parties, modifications shall not retroactively alter completed services or fully executed agreements.
HOME STARLINK LLC may also correct typographical errors, pricing inaccuracies, website content, or administrative errors at any time.
40. SEVERABILITY
If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
Any invalid provision shall be modified only to the extent necessary to make it enforceable while preserving its original intent whenever possible.
41. WAIVER
Failure by HOME STARLINK LLC to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
Any waiver must be in writing and signed by an authorized representative of HOME STARLINK LLC.
42. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado, without regard to its conflict-of-law principles.
Any legal action arising from this Agreement shall be brought in a court of competent jurisdiction located in the State of Colorado unless otherwise required by applicable law.
43. LIMITATION PERIOD FOR CLAIMS
To the extent permitted by applicable law, Customer agrees that any claim arising out of or relating to services performed by HOME STARLINK LLC must be brought within one (1) year after the claim accrues. This provision does not apply where a longer period is required by law.
44. ASSIGNMENT
HOME STARLINK LLC may assign or transfer this Agreement, in whole or in part, to a successor entity or affiliate in connection with a merger, acquisition, reorganization, or sale of its business. Customer may not assign their rights or obligations under this Agreement without the prior written consent of HOME STARLINK LLC.
45. NO THIRD-PARTY BENEFICIARIES
Except as expressly stated in this Agreement, nothing herein creates any rights in or for any third party. This Agreement is intended solely for the benefit of HOME STARLINK LLC and the Customer.
46. HEADINGS
Section titles and headings are provided solely for convenience and shall not affect the interpretation of this Agreement.
47. CUSTOMER ACKNOWLEDGEMENT
By requesting services, scheduling an appointment, submitting payment, clicking “I Agree,” signing electronically, signing a work order, or permitting HOME STARLINK LLC to begin work, Customer acknowledges and agrees that:
* They have read this Agreement in its entirety.
* They understand the rights and obligations described herein.
* They have had an opportunity to ask questions before purchasing services.
* They voluntarily agree to be legally bound by these Terms and Conditions.
* They authorize HOME STARLINK LLC, its employees, independent contractors, subcontractors, and authorized representatives to perform the requested services.
* They understand that HOME STARLINK LLC is an independent installation company and is not affiliated with, endorsed by, sponsored by, or acting on behalf of Starlink or Space Exploration Technologies Corp. (SpaceX).
* They understand that Starlink equipment and internet service must be purchased directly through Starlink.
* They understand that HOME STARLINK LLC is not responsible for Starlink’s products, internet service, billing, warranties, software, account administration, or promotional programs.
* They accept responsibility for obtaining all required permissions and approvals for the installation.
* They agree to all pricing, policies, fees, disclosures, and procedures described in this Agreement.
* They understand that this Agreement is intended to be legally binding to the fullest extent permitted by applicable law.
TEMPORARY WINDOW PASS-THROUGH SETUP, SECURITY DISCLOSURE, ASSUMPTION OF RISK & LIABILITY WAIVER
As an optional convenience service, HOME STARLINK LLC may provide a temporary testing setup that allows the Customer to activate and evaluate Starlink service before a permanent installation is completed.
This temporary setup may include:
* One (1) temporary window pass-through cable.
* One (1) foam window weather seal.
* One (1) magnetic window contact alarm.
* One (1) temporary sliding window security lock with key (when available).
The Customer understands and acknowledges that use of the temporary window pass-through cable may prevent the affected window from fully closing and engaging its factory locking mechanism. As a result, the window may remain partially open or otherwise incapable of being fully secured in the manner originally intended by the window manufacturer until the temporary setup is removed or a permanent installation is completed.
The Customer further understands that the temporary magnetic window alarm and temporary sliding window security lock are provided solely as convenience devices to help increase awareness of the temporary condition. These devices are not professionally monitored security systems, are not guaranteed to prevent unauthorized entry, burglary, theft, vandalism, injury, or property damage, and should not be relied upon as the sole means of securing the premises.
HOME STARLINK LLC makes no representation or warranty regarding the performance, reliability, effectiveness, merchantability, or fitness for a particular purpose of any temporary security device provided. Such devices may fail to operate due to manufacturing defects, depleted batteries, improper installation, misuse, environmental conditions, normal wear, tampering, user error, or other circumstances beyond the control of HOME STARLINK LLC.
The Customer assumes full responsibility for evaluating whether the temporary setup is appropriate for the property and for taking any additional security measures the Customer deems necessary during the temporary testing period, including securing valuables, using additional locks or alarms, or limiting use of the temporary setup.
The Customer acknowledges that they have been informed of the temporary security limitations associated with the window pass-through installation and voluntarily elect to proceed with the temporary setup.
To the fullest extent permitted by applicable law, HOME STARLINK LLC shall not be liable for losses, claims, damages, theft, burglary, unauthorized entry, vandalism, personal injury, property damage, loss of use, or consequential damages arising from or related to:
* The temporary inability to fully lock or latch the affected window;
* Failure or malfunction of the temporary magnetic window alarm;
* Failure or malfunction of the temporary sliding window security lock;
* Unauthorized entry through or near the temporarily modified window;
* Acts or omissions of third parties;
* Criminal acts;
* Customer failure to implement additional security measures; or
* The Customer’s decision to use the optional temporary testing setup.
Nothing in this section is intended to limit or waive any liability that cannot legally be limited or waived under applicable law.
By requesting or accepting the temporary testing setup, the Customer acknowledges that they have read, understand, and voluntarily accept the risks described in this section and agree to the temporary conditions until the permanent installation is completed or the temporary equipment is removed.
